European Metal Recycling (EMR) will restart its deep-sea ferrous export operations in Somerset, Massachusetts after regulatory delays required the company to stop receiving scrap shipments about three months ago. However, the company has shipped out of its Brayton Point location after opening in mid-August.

The date when EMR Brayton Point will receive its first scrap shipments after restarting is undetermined.

Members of Somerset’s Board of Appeals approved a petition during a Dec 19 meeting, allowing EMR to operate at Brayton Point dock. In exchange for approving the petition, the Board imposed restrictions  that limited EMR’s operations, including stipulations for delivery drivers, installation of a traffic camera, delivery time restrictions, limits on quantity of trucks to and from Brayton Point, and limits on scrap pile height.

An Oct 9 cease and desist letter sent to Brayton Point Commerce Center by the town building inspector stated EMR’s operations were in violation of town zoning bylaws though board members later stated that the business does qualify as an acceptable use for the property.

Per an Oct 10 press release the business was required to file planned development applications but could operate until a hearing could be held with the zoning board of appeals.
